- All prices are shown on The Winter Gardens website are correct at time of order plus (VAT at appropriate rate, currently 17.5%). And delivery as stated at Check-Out.
- Payment accepted by credit / debit card as discribed on The Winter Gardens website.
- An acknowlegement of your order will be sent via e-mail when you place an order.
- You must retain your bill of sale or provide other proof of purchase.
- We do not warrant the suitability of goods for a particular purpose, and you should check specifications and suitability with manufacturers before ordering.
- Goods not sold on a trial basis.
- All goods remain The Winter Gardens property until paid for in full.
- Prices and manufacturers specifications subject to change without notice. Minor specification variations do not entitle the purchaser to rescind the contract.
- We shall use our best endeavours to make delivery of the goods as soon as possible after acceptance of your order.
- The Winter Gardens will not accept any responsibility or liability for delay in delivering the goods by any time/date suggested, Time is not of the essence in this contract unless otherwise agreed in writing by The Winter Gardens prior to the date of sale.
- Claims for Transit damage, non-functionality and mis-shipping must be made within 36 hours of receipt. Opened or damaged boxes should be reported to the driver on delivery. And signed for as "damaged/unchecked", Please report to The Winter Gardens as soon as possible.13. A re-stocking/testing fee of up to 20% and return delivery is charged on returns, which prove to be non-defective.
- Any replacement parts provided to the purchaser in fulfilment of this warranty are warranted only for the unexpired portion of the original warranty.
- You must use any manufacturer Warranty or on-site Warranty arrangements provided.
- The warranty will be void if the serial number or product name or identification is missing, defaced or any alteration made.
- You must return the product as sold undamaged with all manuals and related paperwork, warranty cards and any other items that were supplied with the product etc. contained in the original packaging
- Warranty returns can not be swapped for alternate products or cash and must be returned to the manufacturer for replacement or repair at their discretion.
- The warranty applies only to defect in material or workmanship or as limited above and does not include normal product defects that have been caused from use. The warranty applies only to defects which occur during normal use and does not extend to damage to products or parts which results from alternation, repair, modification, faulty installation or service by anyone other than a Competent person, damage to products or parts caused by accident, abuse, or misuse, or maintenance, mishandling, misapplication, use in violation of instruction furnished by the manufacturer; damage which occurs in shipment .
- You are responsible for ensuring safe delivery of the returned item.
- We are not responsible for any consequential loss or expenses, howsoever caused, including incidental returns costs.
The terms and conditions listed above do not affect your rights under the Distance Selling Regulations, Sale of Goods Act 1979, the Sale and Supply of Goods Act 1994, and the Unfair Contract Terms Act 1977.
